The site was published by the brand ËLLËK, registered under the number 919 625 368 00015 under the status of AUTO-ENTREPRENEUR, whose head office is located in Glun 07300. The company's principal activity is textile production and accessories, registered in the Repertoire of Companies and Establishments, and represented by Marie MENDY-BORZOW.

The website www.ellek-studio.com (hereinafter the "Site") is accessible to all users of the Internet network.

The Site provides ËLLËK to offer clothing products (the "Products") for sale to Internet users browsing the Site (hereinafter the "Customer").

Our Site operates on a Pre-order system. As production is limited, if the Customer purchases a Product by Pre-order, he acknowledges that he cannot change size after receipt. The Customer may only be refund for a Pre-order if the Product is defective or damaged.

The general terms and conditions of sale (the "GTC") detailed below apply to all Orders for Products and services placed via the Site (the "Products") with ËLLËK by anyone  (the "Customer").

The Customer must read the Terms and Conditions before placing any Order (the "Order"), the Terms and Conditions being available on the Site.

ËLLËK reserves the right to adapt or modify these Terms and Conditions at any time. The version of the GTC applicable to any sale being the one appearing online on the Site at the time of the Order.

Products and prices

In accordance with article L. 111-1 of the French Consumer Code, ËLLËK presents the Products for sale and their characteristics on the Site. The Customer has the possibility of knowing, before placing a final Order, the essential characteristics of the Products he wishes to purchase.

The Pre-order offers presented by the company ËLLËK are only valid within the limits of the time available and the quantity offered for pre-order.

The photos representing the Products have only an indicative value. These photos, like the texts illustrating the Products, do not enter into the contractual field.

Sales are subject to availability. The Company cannot be held responsible for being out of stock or for the impossibility of selling a Product that is not in stock.

In the case of an Order or Pre-order, the selling price of the Products is indicated on the Site. The selling price of the Products is that in force on the day the order is placed.

The price indicated on the Product page corresponds to the price in euros, all taxes included (TTC), excluding shipping costs.

The price indicated does not include delivery costs, which are added when the order is placed.

Under no circumstances may a User demand the application of discounts that are no longer in effect on the day of the Order.

Order and Pre-order 

Any Order or Pre-order will be confirmed when the Customer clicks on the "Confirm Payment" button.

Confirmation of the Order or Pre-Order implies acceptance by the Customer of the GTC and the essential characteristics of the Products.

As soon as the Order or Pre-Order has been registered, ËLLËK will send to the Customer a confirmation email summarizing the Order (Products, price, quantity, etc.). To this end, the Customer formally accepts the use of electronic mail for confirmation by ËLLËK of the content of the Order. In any case, invoices are issued upon delivery.

In the case of a Pre-Order, the sums paid in advance by the Customer do not constitute a deposit, within the meaning of article 1590 of the French Civil Code.

Payment terms

The Products are payable in euros on the day of the Order. To pay your Order, the Customer has three (3) methods of Payment: Credit Card, Payment by Paypal Account or Payment by Apple Pay.

All Orders or Pre-orders are payable in euros and payment for purchases is made online through a bank payment card, the Customer’s Paypal account or Apple Pay. The Buyer is debited from the full amount indicated on the Order summary on the day of his Order.

The various payment methods accepted for payment of Orders or Pre-orders on the Site are as follows:

- Credit card payment (Visa, Mastercard, American Express)

- Payment by Paypal account.

- Payment by Apple Pay.

For payment by credit card, the customer must provide his credit card number and expiry date, as well as the cryptogram on the back of the card. To ensure the security of online payments, the Customer accesses a dedicated space provided by Stripe, which ensures the security and registration of the payment order and the security of the payment itself. In this respect, the Customer expressly acknowledges that the communication of his bank card number to the Company ËLLËK via Stripe constitutes authorization to debit his account for the amount of the Products ordered.

The data provided for payment by credit card is processed by Paypal in a secure manner. The Seller does not have access to these bank details, and does not keep them on its servers: for this reason, these details are systematically requested during any new transaction on the Site. 

ËLLËK reserves the right to suspend or cancel any Order or Pre-Order and any delivery in the event of refusal to authorize payment by credit card by officially accredited organizations or in the event of non-payment. In particular, ËLLËK reserves the right to refuse to make a delivery or to honour an Order or Pre-order from a Customer who has not partly or fully paid for a previous Order or with whom a payment dispute is in progress.

The goods delivered remain the property of the ËLLËK Company until receipt of the Payment. The transfer of risks to the Customer takes place as soon as the Products are delivered.

Computerized registers, kept in ËLLËK's computer systems under reasonable security conditions, will be considered as evidence of communications, Orders and Payments between the parties. The archiving of purchase orders and invoices is carried out on a reliable and durable medium that can be produced as proof.

Delivery

Delivery is made to the delivery address indicated by the Customer, it being specified that this must be the Customer's home address, the address of a private individual of his/her choice, or the Customer's business address. Delivery cannot be made to hotels or P.O. boxes.

When registering the Customer's personal details, the Customer must ensure the accuracy and completeness of the mandatory data provided. In the event of an error in the recipient's personal information, ËLLËK cannot be held responsible for the impossibility of delivery.

The Customer acknowledges that, in the case of a Pre-order, the delivery time will be extended. The estimated delivery time appears on the product sheet at the time of purchase, and in the Order confirmation e-mail. The delivery time depends on the time required and the production volume of all pre-ordered Products.

ËLLËK cannot be held responsible for the consequences due to a delay in delivery that is not due to ËLLËK or due to an act of force majeure.

Upon receipt of the Products, the Customer must check the condition of the packaging of the goods and report any damage due to the carrier on the delivery slip, as well as to ËLLËK, within three (3) days by sending an email to : contact@ellek-studio.com or by sending an email using the contact form on our website.

Return and refund policy

ËLLËK reserves the right to refuse returns. All purchases are final. We will refund or exchange products only if they are defective or damaged. In the event of a defective item, the customer may return the product back for repair, exchange or refund.

In this case, all requests must be reported by the customer to this address : contact@ellek-studio.com maximum 48 hours after receipt of the products.

Refund (if applicable) 

The Products must be returned by the Customer within 14 days of receipt.

The Products must be returned by the Customer in their original packaging, in its original condition, new, unworn, unwashed.

If the package is lost or damaged when the Product is returned, the cost of the damage will be borne by the Customer.

The Products that are not returned within the aforementioned deadlines and conditions will not be refunded by ËLLËK.

Return costs are not covered by ËLLËK and are the Customer’s responsibility.

The refund will be made within a period of fourteen (14) days from the receipt of the product, by credit on the Customer’s bank account corresponding to the credit card used to pay the Order or Pre-order.

Exchange ( if applicable )

We only exchange Products if they are defective or damaged. If you would like to exchange it for the same article, please email us at contact@ellek-studio.com.

Legal guarantee

All products sold on the Site benefit from the legal guarantee of conformity (as defined in articles L217-4 and following of the Consumer Code) and the guarantee against hidden defects (as defined in articles 1641 and following of the Civil Code).

Article L217-4 of the French Consumer Code:

The seller is obliged to deliver a good in accordance with the contract and is liable for any non-conformity existing at the time of delivery. He shall also be liable for any noncompliance resulting from the packaging, installation instructions or installation where the latter has been charged to him/her by the contract or has been carried out under his responsibility. 

Article L211-5 of the French Consumer Code:

To comply with the contract, the property must:

1) Be fit for the usual intended use of a similar property and, if applicable:

- correspond to the description given by the seller and possess the qualities which the seller has presented to the buyer in the form of a sample or model; - present the qualities which a buyer can legitimately expect having regard to the public declarations made by the seller, by the producer or his representative, in particular in advertising or labelling.

2) Or present the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the knowledge of the seller and which he has accepted.

Article L211-12 of the French Consumer Code: 

The action resulting from the failure to comply shall be prescribed by two years from the date of issue of the property. 

Article 1641 of the Civil Code:

The seller is bound by the warranty on account of the hidden defects of the thing sold which render it unfit for the use for which it is intended, or which diminish this use so much, that the buyer would not have acquired it, or would have given it only a lesser price, if he had known them. 

Article 1648 of the Civil Code: 

The action resulting from the defect must be brought by the purchaser within two years of the discovery of the defect.

Applicable law

These terms and conditions are governed by French law.

Any dispute will fall under the exclusive jurisdiction of the competent French courts. In the event of a dispute or claim, the Customer should first contact ËLLËK to obtain an amicable solution.

Data protection

In order to provide the services offered on the Site, ËLLËK may be required to process personal data concerning you, notably those collected when you register on the Site or place an Order.

Information and data concerning the Customer are strictly necessary for the management of Orders, the execution and follow-up of commercial relations, as well as for internal statistical purposes.

The customer has the right to access, rectify and object to personal data concerning him/her at any time, in accordance with the conditions laid down in the French law of January 6, 1978. To do so, simply send an email to contact@ellek-studio.com and the necessary steps will be taken immediately.

The Customer may receive offers from ËLLËK concerning products or services similar to those already ordered, or newsletters. The Customer will have the right to object to such offers at any time and at no cost, in accordance with the terms and conditions specified in each mailing.

Intellectual property rights

The brand name, logo, graphic charter, photographs and, in general, all elements of this site are the exclusive property of ËLLËK. Any distribution, exploitation, representation or reproduction, whether partial or complete, without the express authorization of the Company will expose the offender to civil and criminal prosecution.
